Please read these Terms of Service carefully. By registering an account or using the iGlobalis platform in any way, you agree to be bound by these Terms. If you do not agree, do not use our services.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and iGlobalis LLC ("iGlobalis," "we," "our," or "us"), governing your access to and use of the iGlobalis freight-matching platform, website, and related services (collectively, the "Platform").
By clicking "I Agree," completing registration, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
iGlobalis is an on-demand freight-matching platform that connects companies and shippers ("Shippers") who need freight transported with independent commercial drivers ("Drivers") available to perform those services across the state of Texas.
iGlobalis acts solely as a technology intermediary. We do not operate as a motor carrier, freight broker, or transportation company. We do not employ drivers, and we do not take possession of, or assume liability for, any freight.
To use the Platform, you must:
Drivers must additionally hold a valid commercial driver's license (CDL) appropriate for the loads they accept, maintain all required federal and state certifications, and carry adequate commercial auto insurance.
You agree to provide accurate, current, and complete information during registration, including your name, email address, CDL class, experience level, location, and availability. You are responsible for keeping this information up to date.
When you accept a load through the Platform, you enter into a direct agreement with the Shipper for that load. iGlobalis is not a party to that agreement. You are responsible for fulfilling the terms agreed upon with the Shipper, including pickup time, delivery, and cargo handling.
You are solely responsible for complying with all applicable federal, state, and local laws and regulations, including FMCSA regulations, hours-of-service rules, weight limits, and all other transportation regulations.
You must maintain, at your own expense, all insurance coverage required by law and as reasonably necessary for your operations, including commercial auto liability insurance. iGlobalis does not provide insurance coverage for Drivers.
When posting a load, you agree to provide accurate information about cargo type, weight, pickup location, delivery destination, pickup date, and pay rate. Fraudulent or materially misleading load postings are prohibited and may result in immediate account termination.
The pay rate listed on a load posting constitutes your commitment to pay the accepting Driver that amount upon successful completion of the delivery, subject to any terms agreed upon directly between you and the Driver. iGlobalis is not responsible for collecting or distributing payments between Shippers and Drivers.
You are solely responsible for ensuring that any freight you post for shipment complies with all applicable laws, including proper packaging, labeling, hazmat classification, and permitting requirements.
Drivers are independent contractors, not employees. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship between iGlobalis and any Driver.
As an independent contractor, each Driver is solely responsible for all income taxes, self-employment taxes, and other tax obligations arising from their work. Drivers are not entitled to any employee benefits from iGlobalis, including workers' compensation, unemployment insurance, health insurance, or retirement benefits.
iGlobalis does not direct, control, or supervise how Drivers perform their services. Drivers have full discretion over how they perform pickups and deliveries, which loads they accept, and when they work.
iGlobalis may charge platform fees to Shippers or Drivers for use of the Platform. Current fee structures, if any, are displayed during registration and within your account dashboard. iGlobalis reserves the right to modify its fee structure with reasonable notice.
iGlobalis is not responsible for disputes between Shippers and Drivers regarding payment for completed or cancelled loads. Such disputes must be resolved directly between the parties involved.
You agree not to:
To the maximum extent permitted by applicable law, iGlobalis and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform.
iGlobalis is not liable for: (a) the actions, omissions, or negligence of any Driver or Shipper; (b) any cargo loss, damage, delay, or theft; (c) personal injury or property damage arising from a Driver's transportation activities; or (d) disputes between Shippers and Drivers.
In no event shall iGlobalis's total cumulative liability to you exceed the greater of (i) the total fees paid by you to iGlobalis in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100.00).
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
iGlobalis reserves the right to suspend or terminate your account at any time, with or without notice, for any conduct that iGlobalis, in its sole discretion, believes violates these Terms or is harmful to other users, iGlobalis, or third parties.
You may close your account at any time by contacting us at dispatch@iglobalis.com. Termination does not relieve you of any obligations incurred prior to the termination date.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered in Dallas County, Texas, in accordance with the American Arbitration Association's Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration against iGlobalis.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, send notice to registered users via email.
Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms.
